These Terms & Conditions ("Terms") govern your use of Bolgini AI calling agent services ("Service") provided by KryptoMindz Technologies ("Company," "we," "our," or "us"). By accessing or using our Service, you agree to be bound by these Terms.
Important: Please read these Terms carefully before using our Service. By using Bolgini, you acknowledge that you have read, understood, and agree to be bound by these Terms.
1. Service Description
Bolgini provides AI-powered calling agent services including:
- Automated outbound calling campaigns
- Intelligent inbound call handling
- Real-time business intelligence and analytics
- Multi-language conversation capabilities
- Integration with business systems and CRM platforms
- Call recording and transcription services
2. Acceptance of Terms
By using our Service, you represent and warrant that:
- You are at least 18 years old and have the legal capacity to enter into these Terms
- You are authorized to bind your organization to these Terms
- You will comply with all applicable laws and regulations
- All information provided to us is accurate and complete
3. User Account and Registration
To use our Service, you must:
- Create an account with accurate and complete information
- Maintain the confidentiality of your account credentials
- Notify us immediately of any unauthorized use of your account
- Accept responsibility for all activities under your account
- Use a valid email address and phone number for verification
4. Subscription Plans and Billing
Our Service is provided on a subscription basis with the following terms:
- Plans: Starter (₹4,149/month), Professional (₹12,449/month), Enterprise (₹37,449/month)
- Billing: Monthly charges are billed in advance
- Auto-renewal: Subscriptions automatically renew unless cancelled
- Usage Limits: Each plan includes specific call minute allowances
- Overage Charges: Additional usage beyond plan limits will be charged separately
- Taxes: All fees are exclusive of applicable taxes
5. Payment Terms
- Payments are due in advance for each billing period
- We accept major credit cards, bank transfers, and digital payment methods
- Failed payments may result in service suspension
- All fees are non-refundable except as specified in our Refund Policy
- Minimum 3-month commitment required for promotional pricing
6. Acceptable Use Policy
You agree not to use our Service for:
- Illegal activities or violation of any laws or regulations
- Harassment, spam, or unsolicited communications
- Fraud, scams, or deceptive practices
- Violation of telecommunications regulations or Do Not Call lists
- Collection of sensitive personal information without consent
- Activities that could harm our infrastructure or other users
- Reverse engineering, copying, or competing services
7. Service Level Agreement (SLA)
We commit to the following service levels:
- Uptime: 99.9% availability (excluding planned maintenance)
- Response Time: API response times under 200ms average
- Support: 24/7 technical support for Enterprise customers
- Data Backup: Daily backups with 30-day retention
- Security: Enterprise-grade encryption and security measures
8. Data and Privacy
Our handling of your data is governed by our Privacy Policy. Key points include:
- We process data only as necessary to provide the Service
- All call data is encrypted in transit and at rest
- You retain ownership of your business data
- We comply with GDPR, CCPA, and other applicable privacy laws
- Data retention periods are specified in our Privacy Policy
9. Intellectual Property
- Bolgini retains all rights to the Service, software, and technology
- You retain rights to your business data and content
- You grant us limited rights to use your data to provide the Service
- No license is granted for unauthorized use of our technology
- Feedback provided may be used to improve our Service
10. Service Modifications and Termination
We reserve the right to:
- Modify or discontinue features with 30 days' notice
- Update these Terms with notification to users
- Suspend or terminate accounts for Terms violations
- Implement security measures as needed
You may terminate your subscription at any time with 30 days' notice. Termination does not relieve you of charges already incurred.
11. Limitation of Liability
To the maximum extent permitted by law:
- Our liability is limited to the fees paid in the 12 months preceding the claim
- We are not liable for indirect, incidental, or consequential damages
- We do not guarantee specific business outcomes or results
- You are responsible for compliance with applicable calling regulations
12. Indemnification
You agree to indemnify and hold us harmless from claims arising from:
- Your use of the Service in violation of these Terms
- Your violation of applicable laws or regulations
- Your content or data processed through the Service
- Claims by third parties related to your calling activities
13. Compliance and Regulatory
You are responsible for:
- Compliance with telecommunications regulations in your jurisdiction
- Obtaining necessary consents for call recording
- Respecting Do Not Call registries and opt-out requests
- Following data protection and privacy laws
- Maintaining appropriate business licenses
14. Dispute Resolution
Disputes will be resolved through:
- Good faith negotiations as the first step
- Binding arbitration if negotiations fail
- Governing law: Laws of Maharashtra, India
- Jurisdiction: Courts of Nagpur, Maharashtra, India
15. Force Majeure
We are not liable for delays or failures due to circumstances beyond our reasonable control, including natural disasters, government actions, internet outages, or other force majeure events.
16. Severability
If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.
17. Entire Agreement
These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and KryptoMindz Technologies regarding the use of Bolgini services.
